1. Who we are
This Policy explains how ECONOTEL CORP, a Florida corporation doing business as VIRFON ("VIRFON," "we," "us"), collects, uses, shares and protects personal information of customers, free-trial users and visitors to our websites and the Virfon app. VIRFON is the controller of your personal information.
Contact: ECONOTEL CORP · 1820 N Corporate Lakes Blvd, Suite 110, Weston, FL 33326, USA · 954-334-4000 · privacy@virfon.com
2. Information we collect
- Identity and contact: name, email address, mobile number, billing address, country, language.
- Account data: username, plan, trial and purchase history, communication preferences, and records of your consents and opt-outs (text accepted, date and time, IP address, number and channel).
- Payment data: card and billing data, processed by our billing and collection provider and payment processors on behalf of VIRFON. VIRFON does not store full card numbers; payment credentials are securely tokenized by the payment processor.
- Telephone service usage data: numbers dialed and received, date, time and duration of calls, usage, and technical data needed to route calls and bill.
- App and device data: device identifiers, operating system, app version, push notification token, technical and error logs.
- Browsing data: IP address, browser, pages visited and data collected through cookies and similar technologies (see Section 11).
- Communications with us: messages, emails and support requests.
We do not knowingly request or collect information from children under 13 (see Section 12).
3. How we use your information
- To create and manage your account, free trial and plans, and to provide the telephone service.
- To bill, collect, and process payments, refunds and disputes.
- To send you service messages (welcome, setup, verification codes, trial expiration notices, payments, technical and security notices).
- To send you promotional messages about VIRFON's own services, only if you agreed (see Section 4).
- To handle support requests and complaints.
- To prevent fraud, abuse and misuse, and protect the security of our network and customers.
- To improve our services through internal analysis, preferably using aggregated or de-identified data.
- To comply with legal, regulatory and tax obligations and requests from authorities.
4. Communications and marketing
4.1 We do not sell or share your information. VIRFON does not sell, rent, trade or share your personal information with third parties for their own advertising or marketing. Occasionally, and only if you agreed, VIRFON sends you information or offers about its own services directly.
4.2 Mobile number and text messaging. We do not share your mobile number or your consent to receive text messages (SMS/MMS) with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with anyone, except with the service providers that deliver messages on our behalf and only for that purpose. All other categories of recipients described in this Policy exclude text messaging opt-in data and consent and the associated mobile number.
4.3 Service and promotional messages. Service messages are part of our relationship with you and never include offers. Promotional messages about VIRFON's own services, through any channel (SMS, WhatsApp, app notifications or email), are sent only with your separate express consent, given by checking a box that is not pre-checked; that consent is not a condition of purchase or of the free trial. Promotional messages: up to four (4) per month, no more than one (1) per day and through only one channel in the same week. Message and data rates may apply.
4.4 Hours and sender identification. We send promotional and non-urgent service messages only Monday to Friday from 8:00 a.m. to 7:00 p.m. and Saturday from 8:00 a.m. to 3:00 p.m., in the recipient's local time, never on Sundays or national holidays of the recipient's country. Messages you request (such as verification codes) and urgent security or payment alerts may be sent at any time. Every message identifies VIRFON (ECONOTEL CORP) as the sender and includes a way to opt out; our postal address and contact details are at https://www.virfon.com/en/contact/.
4.5 How to opt out. You can stop receiving messages at any time:
- SMS/MMS: reply STOP (or QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, OPT OUT, PARAR, BAJA). Reply HELP for help.
- WhatsApp: reply STOP or use the opt-out option in the message.
- Email: use the "Unsubscribe" link included in every promotional email.
- Push notifications: turn them off in the app or device settings.
- In any case: write to servicioalcliente@virfon.com or privacy@virfon.com.
Every opt-out mechanism included in a message remains valid for at least sixty (60) days after it is sent. We apply opt-outs immediately when received through automated means, and in all cases no later than ten (10) business days. An opt-out from a promotional message stops all promotional messages to you on all channels. If you opt out of promotional messages, we may still send messages strictly necessary to operate your account (such as billing and security) while your account is active.
5. Service providers that help us provide the service
To operate your account we use service providers that access only the information needed for their task, act solely on our behalf and under our instructions, and may not use the information for their own purposes. VIRFON (ECONOTEL CORP) remains the party responsible to you for your information and for the service in all cases. They include:
- Billing and collection (outsourced): AIEMPATHIC TECH CORP, doing business as HELLOU.AI (Miami, Florida), is VIRFON's external billing and collection provider. It issues charges and collects payments solely in the name and on behalf of VIRFON, receiving only the data needed for that purpose (name, contact details, plan and payment data). It is not the provider of the service, it does not decide how your information is used, and it may not use your information for its own purposes or to market its own products to you. That is why VIRFON charges may appear on your card or bank statement as "AIEMPATHIC TECH CORP dba HELLOU.AI" (or an abbreviated form of that name).
- Payment processors and financial institutions that process your card.
- Telephone carriers and interconnection providers needed to carry your calls.
- Messaging providers: Twilio for SMS/MMS; Meta Platforms (WhatsApp Business Platform) for WhatsApp; Apple and Google for push notifications; transactional email providers for email.
- Hosting, cloud, analytics and security providers.
6. Other disclosures
- Legal obligations: to comply with law, subpoenas, court orders or other legal process, or requests from competent authorities.
- Protection: to prevent fraud or protect the rights, safety or property of VIRFON, our customers or others.
- Corporate transactions: in a merger, acquisition, financing or sale of all or part of the business, information may be transferred to the successor, which must honor this Policy.
- With your consent or at your direction.
We may share aggregated or de-identified information that does not identify you.
7. Retention
We keep information while your account is active and afterwards only as long as needed for the purposes of this Policy, to comply with legal, tax and regulatory obligations (for example, billing and call records), resolve disputes, and keep proof of consents and opt-outs (at least 5 years for consent and opt-out records). When you update your information, we may keep the prior version only when needed for those purposes; afterwards we delete or de-identify it.
8. Security
We use reasonable administrative, technical and physical safeguards to protect information against loss, misuse, unauthorized access, disclosure, alteration and destruction, and update them as new technologies become available. No system is 100% secure. If a security incident affects your information, we will notify you as required by applicable law.
9. Customer Proprietary Network Information (CPNI)
Information about your use of the telephone service (numbers called, duration, frequency, type of service) is Customer Proprietary Network Information (CPNI) protected by U.S. federal law. We do not use or disclose your CPNI for purposes other than providing and billing the service without your authorization where the law requires it, and we protect it with authentication measures.
10. Your rights and choices
You may at any time and free of charge: access your information, correct or update it, request deletion where we have no legal obligation to keep it, withdraw your consent to promotional messages, and file complaints. Write to privacy@virfon.com; we will respond within applicable legal deadlines and may verify your identity first.
- U.S. residents: depending on your state of residence, you may have additional rights, which we will honor as required by applicable law. We do not sell personal information.
- Data subjects in Colombia: under Law 1581 of 2012 and its regulations, you may know, update and rectify your data, request proof of the authorization you gave, be informed about the use of your data, revoke your authorization or request deletion where appropriate, and file complaints with the Superintendencia de Industria y Comercio after first submitting your inquiry or claim to us. Inquiries are answered within 10 business days and claims within 15 business days.
- Residents of Canada: you may access and correct your information and withdraw consent, as provided by applicable Canadian law.
11. Cookies and similar technologies
Our websites use cookies and similar technologies to function, remember preferences, measure traffic and improve the service. We use first-party session and attribution cookies (such as `vf_vid`) to operate our trial and activation forms and measure site performance. You can set your browser to reject or delete cookies; some features may not work.
12. Children
Our services are intended for people 18 and older. Consistent with the Children's Online Privacy Protection Act (COPPA), we do not knowingly request, collect or keep information from children under 13. If you believe a child has given us information, write to privacy@virfon.com and we will delete it.
13. International transfers
VIRFON is located in the United States. If you are in another country (for example, Colombia or Canada), your information will be transferred to and processed in the United States and, where applicable, in countries where our authorized providers operate, with appropriate safeguards.
14. Trademarks
"Virfon" is a trademark of ECONOTEL CORP. Other marks on our websites belong to their owners. We do not control or endorse the content of third-party websites.
15. Changes to this Policy
We may update this Policy. We will post the new version with its date and, for material changes, notify you by email before they take effect. We will not use your information in a materially different way from what we disclosed when we collected it without your consent where the law requires it.
